    Trespass

     I read with interest the article on the home page about dealing with travelers.  Very sad to me how few rights you actually have as landowners/tenants regarding trespass.  The Sheriff would evict them immediately, no lengthy process to go through.  I guess I should be more thankful for what we have over here.  It isn't perfect, but all things considered, it isn't bad.

     You must remember Kansas that this country is a truly socialist nation in every sense of the word. The underdog,the lazy and the criminals are the real heroes here. Success and enterprise are regarded by our rulers as being politically incorrect and immoral for they believe .as Karl marx said ,' Property is theft '.

    So if you are invaded or burgled it is your own fault for flaunting your illgotten gains. I was recently on a BBC TV show called ' The Big Question' with Nikki Cambell and this question of property rights and the right of the householder to protect himself against these crimminals was the main theme and with the exception of myself and another couple of people, all the vicars and the do gooders on the show sought to say that it was the burglar who was the true victim for he was made that way by our capitalist system and needed help not punishment. I nearly choked with anger and I am sure, that I for one will not be welcome on future shows.

    The extent of "control" here was illustrated in a report today in the Telegraph. A lawyer at Eversheds was going to interview a woman who had recently had a baby for a vacant position. He inquired in an email to a couple of senior colleagues as to how he could ascertain that the lady concerned had suitable childcare etc in place. In other words how could he ascertain that she was sufficiently organised on the home front to do the job in hand. Now, in this country you apparently can't ask interviewees these things but, more alarmingly, the lawyer concerned was put through an internal inquiry and sent on an employment law course (I believe he was actually an International lawyer by profession) for simply asking his senior colleagues' advice. If you are punished for asking for advice on what is a complex subject - how long is it before we are all subjected to the thought police?

    I will use contractors and self employed individuals but in the current climate I will never employ staff. I fear I can't afford great debates on the work/life balance when there are a whole load of ewes about to lamb. The rams will be asking for paternity leave next!

     I have had two experiences regarding this type of illegal Tresspass perhaps not quite in the same vein as the Travellers but it still amounts to the same thing.

     1] A licence agreement with a chap for some land allowed for the monthly use of same.The Licencee proceeded to put a Mobile home on the Land and live in it.The Local Planning Enforcement Officer arrived and I explained to him that the Licencee did not have my permisson to use the Land for this purpose.He told me I must get an Eviction Order from the Courts .That cost me three thousand pounds and he stayed for another four or five months while this was implemented and no Rent came in this period.

     2] A very Wealthy Business Man took a Unit from me three Years ago on a monthly Licence.He informed me he was leaving at the end of the Month I re let the Unit but he would not Vacate saying he wanted more time on two further occasions.The incumbent Licencee was under pressure from a Contract he had taken to use the Premises to the tune of £150,000.I last week went to Lawyers for you on line,cost £25, Answer:  A Tenant has rights in Law to possesion of Land as does a leasee.A licence to use Land or Property is suseptable to one days notice and if not complied with the Goods can be removed taken to a Lockable premises and money demanded for the removal and Storage of such and if not paid the Goods can be put up for Public Auction. The Licencee went to his Solicitors and will be out this Friday,Cost to me £25 and two Letters.

      I would do the same with Travellors,I would give them 24 hrs notice and have a Witness present then remove their Property as Advised above and I would tell the Police what I was going to do.

      The Legal Fraternity are always looking to enhance their ways of soaking the situation for their own ends, The Law usually has been written with a way of sure outcome ,Lawyers try and cloud it.

    the best way to deal with travellers is to prevent them arriving.

    we have had them on some land before, which we tenant, but the owner got them off with the police. we didnt get involved, as our sheds, stacks, and machinery are too vulnerable to revenge attacks.

    another area which is vulnerable has a big dung midden now, plonked right in the middle.

    access must be kept rough, 4wd only, muddy preferably, big rocks etc.

    We have some land on the Derbyshire/Leicestershire border which is planted with trees under a Forestry Commission grant. Some travellers were turfed off some Council-owned land in the area and promptly broke a gate or two down to settle on ours. We were fortunate that a neighbour phoned us (we are about 100 miles away) and the other half has had legal training and went off to acquire an injunction. (Not too expensive if you are able to do it yourself). This was presented to the convoy and they drifted off the next day - leaving quite a bit of mess. Needless to say we had great squawks from the local "Gypsy liaison officer" of the Council about these peoples' "human rights". Damned nerve seeing that it was the same Council who threw them off their land in the first place. I am glad to see that Mr Cameron is making noises about burglars leaving their human rights at the door when they break into someone else's property. Similarly, it can never be right that people can just march onto someone else's property and then claim they have "a right to family life" on that property. What about the landowner's human rights to peaceable enjoyment of his land? I do like Kansas' Sheriff  - how much is it to hire him?!!

     A couple of months ago there was a minature horse sloten from our are that happened to turn up a a camp of serverly misunderstood people that wouldn't really steal anything it just happened that they had a horse exactly the same even down to the same microchip.

    Now there is a orange van doing the rounds that happens to be know to the police and just so happens to be from the same camp that happened to be spotted trying to load a large reel of electric cable that didn't happen to belong to them. When you then hear rather than just calling the local station to report if its been seen, you get told to dial 999 and tell them that x pc wanted to be informed straight away when it spotted and in what direction its going doesn't leave you with a fuzzy feeling of the they are taking rural theft seriously it make you wonder what else they have been up to.
