Tackle giants in legal wrangle
TWO international machinery giants are embroiled in a High Court legal row over machinery patent rights.
New Holland has issued a High Court writ against the Massey Ferguson Group, and its parent company Agco Corporation over patent rights relating to Hesston balers.
The writ includes allegations of "patent infringement, infringement of registered trade mark, misuse of confidential information infringement of copyright, breach of contract and interference with contractual relations".
The writ was issued on Jan 12 and Massey had until Thurs (yesterday) to decide whether it will contest the claims. ACGO has until Feb 2 to make its decision.
The writ states that New Hollands claim is for an injunction to stop Massey and ACGO, or their agents, infringing patent rights relating to Hesston balers. Hesston is a US company based in Kansas.
It also calls for an enquiry into the damages suffered by New Holland or "an account of profits accrued to the defendants by reason of their acts."
