Keep rights of way open — CLA

FARMERS have been urged to restore public footpaths and bridleways if they are disturbed during the annual plough-up following harvest.

The Country Landowners Association has warned that farmers could risk prosecution and heavy fines if they fail to observe the ploughing code and ignore their legal responsibility to safeguard public rights of way.

They must also ensure that rights of way do not become blocked by growing crops and adjoining vegetation.

Mid-Wales CLA regional director Julian Salmon said: “Under the Rights of Way Act 1990, occupiers of land are required to safeguard rights of way as instructed by the ploughing code and keep their surfaces clear of growing crops other than grass used for pasture, silage or hay-making.

“They must also cut back all vegetation which encroaches from the sides and above, including crops, hedges and overhanging branches.”
