Judge to rule on TB compensation case

Devon farmer David Partridge will learn today (1 April) whether his challenge to DEFRA’s bovine tuberculosis valuation system has been successful.

Mr Partridge thought he had won a legal victory in July 2008 when he took on the government over the way TB compensation was paid for high value animals.

Lord Justice Stanley Burnton, ruled the compensation scheme violated European equal treatment rules and ordered DEFRA to fundamentally rethink it, to make it fairer.
 
Left facing the prospect of increased compensation bills and a potential avalanche of claims from farmers who believed they too had been under-compensated, DEFRA appealed.
 
Lord Justice Ward, Lord Justice Keene and Lord Justice Lawrence Collins will deliver their ruling on DEFRA’s appeal at London’s Civil Appeal Court today.
