Farmers invited to apply for 2026 NVZ grassland derogation

Farm businesses operating within nitrate vulnerable zones (NVZs) can now apply for an annual grassland derogation for 2026.

Applications must be submitted to the Environment Agency (EA) by 31 December 2025.

The derogation permits farms to use up to 250kg/ha of nitrogen, compared with the standard limit of 170kg/ha, provided the nitrogen originates from eligible grazing livestock.

This includes cattle (except veal calves), sheep, deer, goats, and horses.

Manure from veal calves, pigs, or poultry remains restricted to the lower limit.

Eligibility requires that at least 80% of a holding’s agricultural area is grassland used for agricultural purposes.

Successful applicants will be notified directly by the EA.

NFU dairy board chairman Paul Tompkins described the NVZ grassland derogation as a “critical tool” that helps applicants maintain viable farm businesses and plan for the year ahead.

He added: “The NFU continues to lobby for multi-year derogations to be introduced to reflect the long-term nature of dairy and livestock farming and nutrient management planning, and to reduce the administrative burden and provide producers with the confidence to plan for their business.”
