THE British Pig Industry Support Group is hoping that the question over its ability to pay costs if it loses its court case against MAFF will have been resolved by the end of this week.
At last weeks two-day judicial review into alleged discrimination by MAFF against the pig industry, Mr Justice Richards gave the two sides seven days to reach an agreement on the issue. This followed a request from MAFFs lawyer for the judge to give clear guidance on the capacity of BPISG as an "unincorporated association" to bring the case.
If agreement between the sides has not been reached by the end of week the judge will have to make a ruling.
If this ruling goes against BPISG it will lose the whole review.
But BPISG spokesman Digby Scott was confident the matter was going to be resolved. "We have the funds. It is just a matter of sorting out the details about how the money would be paid," he said.
If this hurdle is overcome Mr Richards is expected to deliver his decision on the case in about two weeks. *
